Introduction and Acceptance of Terms

Welcome to UGCraft. By accessing or using our service, you agree to be bound by these Terms of Service. If you do not agree with any of these terms, please do not use our service.

Age Requirements

UGCraft is intended for users aged 13 and older, in compliance with:

COPPA (Children's Online Privacy Protection Act)
Roblox's age requirements for UGC creators
International age verification standards

If you are under 18, you must have parental or guardian consent to use our service. Parents or guardians may request deletion of a minor's account at any time by contacting support@ugcraft.ai.

If you are under 13, you are not permitted to use UGCraft. We will promptly delete any accounts we discover belong to users under 13.

Use of the Service

UGCraft provides users with AI-powered tools to generate and manage Roblox UGC-ready 3D accessories. You agree to use the service in accordance with all applicable local, state, national, and international laws and regulations.

User Accounts and Registration

Account Creation: To access certain features of the service, you need to create an account. You must provide accurate and complete information during the registration process.
Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
User Responsibilities: You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
Account Termination: You may delete your account at any time through your account settings. We may suspend or terminate your account for violations of these Terms.

AI-Generated Content Ownership and Rights

Your Ownership Rights

You Own Your Creations: You retain full ownership and all intellectual property rights to the 3D accessories you generate through UGCraft
Input Rights: You represent and warrant that you have the right to use any reference images, text prompts, or other materials you upload
Commercial Use: You are free to sell, distribute, monetize, or otherwise use your generated accessories on Roblox Marketplace or elsewhere without restriction
Modifications: You may modify, adapt, or create derivative works from your generated content

UGCraft's Rights

Platform Technology: UGCraft retains ownership of the underlying AI technology, software, infrastructure, and platform
Portfolio Use: We may use thumbnails and previews of your public creations for marketing, promotional, and portfolio purposes
No Training Use: We do NOT use your generated content, input prompts, or uploaded images to train our AI models
License Grant: By using our service, you grant us a limited, non-exclusive license to host, store, and display your content as necessary to provide the service

Third-Party Rights

Roblox Compliance: All generated content must comply with Roblox's Terms of Service, Community Standards, and UGC Program Guidelines
No Infringement: You are solely responsible for ensuring your creations do not infringe on third-party intellectual property rights, including copyrights, trademarks, and patents
Indemnification: You agree to indemnify UGCraft against any claims arising from your use of generated content

Content Standards and Prohibited Uses

Prohibited Content

You may not use UGCraft to generate, create, upload, or distribute content that:

Infringes Intellectual Property: Copyrighted characters, logos, brands, trademarks, or other protected works without authorization
Explicit or Inappropriate: NSFW content, sexually explicit material, graphic violence, or disturbing imagery
Hate Speech: Content promoting discrimination, racism, sexism, homophobia, or hatred against any group
Illegal Activities: Content promoting illegal activities, drugs, weapons, or violence
Misleading Content: Deceptive, fraudulent, or misleading content
Harassment: Content targeting, bullying, or harassing individuals
Malicious Code: Content containing viruses, malware, or harmful code
Roblox Violations: Content that violates Roblox Community Standards or UGC Guidelines

Content Moderation

Review Rights: We reserve the right to review, monitor, and remove any content that violates these standards
Automated Tools: We may use automated systems and AI to detect prohibited content
Manual Review: Our team may manually review reported or flagged content
Account Actions: Repeated violations may result in warnings, temporary suspension, or permanent account termination
No Prior Notice: We may remove content or suspend accounts without prior notice for severe violations

DMCA and Copyright Compliance

If you believe your copyright has been infringed, please contact us at dmca@ugcraft.ai with the following information:

Description of the copyrighted work claimed to have been infringed
URL or location of the allegedly infringing content on UGCraft
Your contact information (name, address, email, phone)
A statement of good faith belief that the use is not authorized
A statement under penalty of perjury that your information is accurate
Your physical or electronic signature

We will respond to valid DMCA notices within 72 hours and remove infringing content as required by law.

Service Limits and Fair Use

Usage Limits

Our service plans include the following usage limits:

Free Plan: 10 generations per month
Pro Plan: 100 generations per month
Studio Plan: Unlimited generations with fair use rate limiting
API Access: Rate limits apply based on your plan (if applicable)

Fair Use Policy

You agree not to:

Use automated scripts, bots, or tools to generate content in bulk
Abuse the service to circumvent Roblox restrictions or policies
Resell or redistribute generated content as templates without authorization
Create multiple accounts to bypass usage limits
Use the service in a manner that degrades performance for other users
Reverse engineer, decompile, or attempt to extract our AI models

Violation Consequences: Violations of fair use may result in temporary rate limiting, plan downgrade, or account suspension.

Content and Intellectual Property Rights

All content provided through UGCraft, including but not limited to the platform interface, AI models, templates, code, infrastructure, and documentation, is protected under copyright law. The copyright owner of UGCraft is ugcraft.ai.

You acknowledge that you do not own the underlying technology or intellectual property that makes up the UGCraft service
You agree to respect the intellectual property rights of ugcraft.ai and any third parties
While you retain ownership of your generated creations, the core UGCraft platform, AI models, and templates remain the property of ugcraft.ai

Pricing, Payments, and Refunds

Prices are subject to change with 30 days advance notice to active subscribers
You agree to pay all charges associated with your selected plan
Payment is processed through secure third-party payment processors (Stripe)
Subscription automatically renews unless you cancel before the renewal date

Refund Policy

We offer refunds in the following circumstances:

Service Outage: If our service is unavailable for more than 24 consecutive hours (pro-rated refund)
Billing Errors: If you were charged incorrectly due to our error
Subscription Cancellation: Pro-rated refund for unused time if you cancel within 7 days of initial purchase
Legal Requirements: As required by consumer protection laws in your jurisdiction

No Refunds For:

Change of mind after using the service
Unused credits, generations, or features
Generated content quality that doesn't meet your expectations
Account termination due to Terms violations
Subscriptions canceled after the 7-day window

Refund Requests: Contact support@ugcraft.ai within 14 days of the charge with your order details.

Free Trial Terms

Free trials are limited to one per user
Credit card required for trial activation
Automatic conversion to paid subscription unless canceled before trial end
Trial benefits may be modified or discontinued at any time

AI-Specific Disclaimers

No Guarantees on AI Output

IMPORTANT: AI-generated content is probabilistic and variable. We make no guarantees or warranties regarding:

Accuracy: Generated 3D models may not precisely match your text descriptions or reference images
Quality: Output quality varies based on complexity, prompts, and other factors
Consistency: Results may differ between generation attempts with the same input
Roblox Approval: We do NOT guarantee your content will be approved by Roblox's UGC marketplace
Technical Compliance: Generated models may require manual adjustments to meet Roblox's technical specifications
Commercial Viability: We make no claims about the commercial success or marketability of generated content

Your Responsibility

You are solely responsible for:

Reviewing All Content: Carefully review all AI-generated content before use
Testing: Test generated 3D models in Roblox Studio before uploading to the marketplace
Compliance: Ensuring your content meets all Roblox requirements and guidelines
Quality Assurance: Making any necessary manual adjustments or fixes to generated models
Legal Compliance: Ensuring your use of generated content complies with all applicable laws

UGCraft is a tool: We provide technology to assist creation, but you bear full responsibility for the final product and its use.

Prohibited Activities

You agree not to engage in any of the following prohibited activities while using UGCraft:

Unauthorized access to or distribution of our proprietary code, AI models, or templates
Reselling or redistributing UGCraft templates or technology without written authorization
Interfering with or disrupting the security, performance, or integrity of the service
Using the service for any illegal or unauthorized purpose
Attempting to bypass security features, rate limits, or usage restrictions
Uploading malicious code, viruses, or harmful content
Impersonating others or misrepresenting your affiliation with any entity
Collecting or harvesting user data without consent
Creating fake accounts or engaging in fraudulent activity

Termination

Your Right to Terminate

You may terminate your account at any time by:

Using the account deletion feature in your settings

Your data will be deleted in accordance with our Privacy Policy

Our Right to Terminate

We reserve the right to terminate or suspend your access to the service at our sole discretion, with or without notice, for conduct that:

Violates these Terms of Service
Violates our content standards or prohibited use policies
Is harmful to other users, our service, or third parties
Exposes us to legal liability
Is fraudulent or involves payment disputes

Effect of Termination: Upon termination, your right to use the service ceases immediately. We may delete your account data subject to our data retention policies.

Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND.

To the fullest extent permitted by law, UGCraft disclaims all warranties, express or implied, including but not limited to:

Merchantability: Fitness for a particular purpose
Non-Infringement: That the service won't infringe third-party rights
Accuracy: Accuracy, reliability, or completeness of content
Availability: Uninterrupted or error-free operation
Security: Complete security or freedom from viruses
Results: Any particular results from using the service

Your Use is at Your Own Risk: You understand and agree that you use UGCraft at your own discretion and risk.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

UGCraft.ai, its affiliates, officers, directors, employees, and agents shall NOT be liable for any:

Direct Damages: Loss of profits, revenue, data, or business opportunities
Indirect Damages: Incidental, consequential, special, or punitive damages
AI-Related Issues: Problems arising from AI-generated content quality or accuracy
Third-Party Services: Issues caused by Roblox, payment processors, or other third parties
User Content: Damages arising from user-generated or uploaded content
Service Interruptions: Downtime, outages, or loss of access to the service

MAXIMUM LIABILITY: Our total liability for all claims shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.

Some Jurisdictions: Do not allow limitation of liability for incidental or consequential damages, so these limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless ugcraft.ai, its affiliates, and their respective officers, directors, employees, contractors, and agents from and against any:

Claims, lawsuits, or legal actions
Damages, losses, or liabilities
Costs and expenses (including reasonable attorneys' fees)

Arising from or related to:

Your use or misuse of the service
Your violation of these Terms
Your violation of any law or third-party rights
Content you generate, upload, or distribute through UGCraft
Your breach of any representation or warranty in these Terms

Force Majeure

UGCraft shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:

Natural disasters (earthquakes, floods, fires)
Acts of war, terrorism, or civil unrest
Government actions or regulations
Internet service provider failures or telecommunications outages
Third-party service outages (AWS, Stripe, Roblox APIs)
Pandemics or public health emergencies
Power outages or infrastructure failures

During force majeure events, our obligations are suspended for the duration of the event.

Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Dispute Resolution

Informal Resolution: Before filing a claim, you agree to contact us at legal@ugcraft.ai to attempt informal resolution.

Arbitration Agreement: Any disputes arising from these Terms or the service will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.

Class Action Waiver: You agree to bring claims only in your individual capacity, not as a class member or representative.

Small Claims Court: You may bring claims in small claims court if they qualify.

Exceptions: Either party may seek injunctive relief in court for intellectual property infringement.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and UGCraft regarding your use of the service and supersede all prior agreements, understandings, and representations.

Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign or transfer these Terms and our rights and obligations at any time without restriction.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of UGCraft.

Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting on our website unless otherwise stated.

Displaying an in-app notification

Your Acceptance: Your continued use of the service after changes are posted signifies your acceptance of the new Terms. If you do not agree with the changes, you must stop using the service and may request account deletion.
